He Forgets that it Works Both Ways

The latest bit of nonsense from Bill Schmalfeldt is quite spectacular in its breadth and depth.

Let’s suspend reality here for a second. Assume that yes, this latest vomitous from Bill will actually pass both IFP and Magistrate Judge approvals. (STOP LAUGHING! That’s not nice!)

As a named defendant, I, too, get subpoena power. And guess what I can subpoena. Things Bill Schmalfeldt probably doesn’t want me to have. To wit:

  1. His complete military service records from the NPRC in St. Louis. Because I find it HIGHLY interesting that for all the times he has sued for Libel and DEFAMAAAAAAAAATION that he has never, not once, suggested in a pleading that anyone has ever lied about his military service in a blog post or comment. Or at least, not in such a way that damaged his reputation.
  2. His personnel files at his latest job, including why he left their employ.
  3. The records kept by the NINJANUNS including all correspondence from the Lovely and Talented Cindy in regards to any complaints about Bill (foreign and domestic) and the reason why he left said domicile.

And that’s just for starters. Two can play at this game.

    The requests for discovery that YOU are contemplating are relevant to whether his “just fine” reputation was perhaps somewhat less stellar than he alleges or to whether something you said was true.

    It is not logical to equate relevant requests with irrelevant ones. It is wrong to suggest that you and he are playing the same game.

    Does the DF realize that if this ever makes it to discovery, you will get the power of subpoena and will be able find out what his miracle cure for stage 4 Parkinson. He was on deaths door according to his legal filings yet he is able to get a job (he couldn’t keep it an you get to find out why) he was able to drive and move from state to state. Those will just be a few of many things you will be entitled to in discovery.
