“I was not told to ‘knock off with the emails.'”
Famous. Last. Words.
The actual text says:
“… Plaintiff sent an email to the regarding his Amended Complainnt addressed to (the judges) assigned to this case. THIS WAS IMPROPER…. A PRO SE LITIGANT IS NOT PERMITTED TO COMMUNICATE WITH THE JUDGES OF THIS COURT OR WITH THE CLERK OF COURT’S OFFICE THROUGH EMAIL.”
It doesn’t matter that Bill Schmalfeldt sent only one. He sent something improper. It got round-filed. (snort!) He was told:
“PLAINTIFF SHOULD REFRAIN FROM ANY ATTEMPT TO DO SO (send an email to the judges or the Clerk of the Court) IN THE FUTURE.”
That, zombies and zombettes, is what we call a BENCH SLAP. Couldn’t have happened to a nicer guy.
He should get the rules. Both local and the FRCP. Read them. Read them long and hard. And maybe, JUST MAYBE, Bill Schmalfeldt might figure out what he’s doing wrong.
Here’s a hint.
It starts with “Now comes Plaintiff Bill Schmalfeldt….”
